I would like to express my disappointment with the decision by the Army Corps of Engineers to use the Brooklyn Marine Terminal and the Castle Astoria dredge sediments as capping materials at the Mud Dump site, three miles off Sandy Hook, N. J. ( currently being called the HARS ) Although Vice President Al Gore gave us his word there would be no more dumping at this site, the Army Corps of Engineers has found a way to disregard the wishes of the American people and their government. The dredge spoils coming out of the Castle Astoria and the Brooklyn Marine Terminal are loaded with petrochemicals and PCBs. How the Army Corps of Engineers is allowed to consider this "clean" capping material is incomprehensible. The opportunity to express an opinion was denied at the public hearings by the inappropriate actions of Colonel Pierce of the Army Corps of Engineers with what could only be construed as a deliberate attempt to undermine the democratic process. The meetings held on January 25, 2000 were completely out of control. Members of the population who attempted to speak their opinions were taunted, shouted at, and threatened at both the afternoon and evening meetings held by Colonel Pierce. I am not against the dredging of the shipping lanes to continue commerce. I am against dumping toxic materials, from private industries into our oceans. The dredged materials being used for capping our Toxic Stain must meet a strict criteria. Clean Capping Material needs further defining and should pass stringent testing. Those materials should also come from Port Authority areas and not private concerns. Castle Astoria is a private corporation. Castle Astoria and the Brooklyn Marine are also New York concerns. Why is it their toxic wastes are dumped off the Jersey Shore? Why is it New York refuses to use their upland alternative sites? Could it be too toxic? I am asking for a complete investigation on the material considered for capping. The EPA needs to develop an up to date criteria for the materials being designated as "clean capping" to insure it is not just another attempt at dumping toxins in our oceans. One that has strict guidelines for what is to be considered "clean". A definition of clean which would include "no Toxins or Petrochemicals." I would like to know how you stand on this issue.
